Making the decision to end a marriage is incredibly difficult, and the legal process that follows can seem complex and overwhelming. In India, the divorce process is primarily categorized into two types: Mutual Consent Divorce and Contested Divorce. This guide provides a clear, step-by-step overview of what to expect when filing for divorce in Kerala.

Mutual Consent Divorce (The Amicable Path)

When both spouses agree that the marriage has irretrievably broken down and decide to separate amicably, they can file for a mutual consent divorce under Section 13B of the Hindu Marriage Act. This is the most peaceful and fastest route. The primary requirements are that both parties have been living separately for a period of at least one year and have mutually agreed to dissolve the marriage.

The process typically involves the following steps:

  1. Filing a Joint Petition: Both spouses file a joint petition before the Family Court. This petition states their mutual consent to end the marriage and includes agreements on matters like alimony, child custody, and division of assets.
  2. First Motion: Both parties appear in court to record their statements. After this, the court grants a mandatory “cooling-off” period of six months.
  3. Second Motion: After the six-month period (and before 18 months from the First Motion), the parties must appear again to reaffirm their consent.
  4. Final Decree: If the court is satisfied that the consent is genuine and all conditions are met, it will pass a final decree of divorce, officially dissolving the marriage.

Contested Divorce (When Agreement Isn’t Possible)

When one spouse wants a divorce but the other does not, or when there is no agreement on key issues, a contested divorce is filed. This process is more complex and lengthy, as it involves proving specific grounds for the divorce in court. Common grounds include cruelty (physical or mental), desertion, adultery, and conversion to another religion.

“In a contested divorce, the burden of proof lies with the spouse who is filing the petition. Meticulous documentation and strong evidence are essential.”
